These User Terms and Conditions (the “Agreement“/”Terms and Conditions”) govern your (“You, Your, User”) use of this website, www.limelightdiamonds.com (the “Website“), including Limelight Lab Grown Diamonds Private Limited’s (“Company”/”We”) offer products for purchase on this website or your purchase of products available on this website.

This Agreement includes, and incorporates by this reference, the policies and guidelines referenced below. The Company reserves the right to change or revise the terms and conditions of this Agreement at any time by posting any changes or a revised Agreement on this Website. The company reserves the right to update the website and these terms of service from time to time, at its discretion and without any notice. It is solely your responsibility to keep up-to-date with the latest Terms and Conditions by checking back regularly. Your continued use of the website following the publication of updated terms of service or Terms and Conditions will be taken as your acceptance of the changes. The company encourages you to review this agreement whenever you visit the website to make sure that you understand the terms and conditions governing the use of the website. This agreement is independent of any other written agreement you may have with the company for other products or services. If you do not consent to this Agreement (including any referenced policies or guidelines), you are requested to immediately terminate your use of the Website.

The terms ‘we,’ ‘us,’ and ‘our’ refer to the company, its affiliates, and assignees, and the term ‘you’ refers to any person procuring products or services from any supplier through the site. Persons means any natural person, firm, company, joint venture, association, partnership, limited liability partnership, society, or other entity (whether or not having separate legal personality) in the relevant country. Words importing the singular include the plural and vice versa, and pronouns importing a gender include each of the masculine, feminine and neutral genders.

ACCESS TO THE WEBSITE

We work hard to ensure the website is always up and available, but we can’t guarantee that the website will not have downtime for any reason. We reserve the right to close the website for short periods of time for general maintenance but will attempt to keep this to a minimum. We will not be held liable for the dysfunctionality of any part of the website (for any reason) for any length of time.

Parts of the website require you to input a password to access certain features. This is to be able to give you details relevant to your order whilst still keeping them private to you. To do this, as part of our security procedures, we require you to register an account with the company by entering your email and choosing a secure password. We highly recommend that you choose a strong password that is hard for others to guess, and you log out from your account at the end of every session. There is a password reset procedure in case you forget your password. You must treat your account log-in information as confidential, not disclosing it to any third party and only using the company in person. If you think there may have been any breach of security, then it is your responsibility to notify us immediately, and if log-in is possible, to change your password.

It is a condition of your use of the website that all the information you provide on the website is correct, present, and complete. We reserve the right to disable any user account in our sole discretion at any time for any or no reason, including if, in our opinion, you have failed to comply with any provision of these terms of service.

We do not guarantee that the website or any content provided on the website is error-free.

PRODUCT INFORMATION

The company takes great care when putting product information, descriptions, and images online but will not be held responsible for any mistakes or omissions to any information given. The company states that the images available on the website are only indicative. This website offers lab-grown diamond jewellery for personal consumption, inclusive of customised and readymade jewellery.

Some items may appear slightly larger or smaller than their actual size due to screen defaults and photography techniques. Sometimes the items may be represented larger than the actual size in order to clearly show details or smaller than the actual size in order to show the entire item. The company shall not be liable for any legal action on this account.

WARRANTY FOR ACCESSORIES:

This product is covered by a Limited Warranty issued by Limelight Lab Grown Diamonds Limited (“Company”).

Warranty Coverage for Pens:

  • 3 (three) months Warranty on Refill Only – Free replacement of pen refill for manufacturing defects within 3 months from date of purchase.
  • It is hereby clarified that nib of the pens is not covered under warranty and is specifically excluded from the same.

Key Exclusions:

  • Damage due to misuse, dropping, improper ink usage, leakage, corrosion, or negligence.
  • Cosmetic wear and tear.
  • Unauthorized modification or repair.
  • No buy-back, return, or exchange.

Warranty Coverage for Belts:

  • 1 Month Limited Warranty against manufacturing defects only, from the date of purchase.

Key Exclusions:

  • Normal wear and tear, scratches, creasing, discoloration, or material aging.
  • Damage due to misuse, improper storage, or alteration.
  • No buy-back, return, or exchange.

Warranty for Other Accessories:

All other accessories apart from the once mentioned above shall be considered to be other accessories, which shall include but not limit to kurta buttons, cufflinks, brooches, etc. The Company does not extend any warranty towards such other accessories. Further, the Company shall not be liable to accept buy-back, return or exchange for such other accessories.  

Laboratory Grown Diamond Setting Policy:

  • The Company may at its sole discretion replace lost diamonds on the accessories, however it is not an obligation on the Company to do so, the Company may choose not to replace the same for any reason whatsoever, with or without cause

Conditions to Claim Warranty for Accessories:

  • Valid only for products purchased through authorized sales channels.
  • Original purchase invoice is mandatory for any warranty claim.
  • Watch must not be opened, altered, or serviced by unauthorized persons.

Watch warranty policies:

1.              Limited Warranty Coverage

Subject to the terms, conditions, limitations, and exclusions stated herein, the Company provides the following limited warranties:

1.1.        One (1) Year Limited Warranty on Movement:

The Company warrants that the internal watch movement shall be free from manufacturing defects in workmanship for a period of one (1) year from the date of purchase.

In the event of a covered defect within the warranty period, the Company shall, at its sole discretion:

    • Repair the defective movement; or
    • Replace the movement; or

This warranty strictly applies only to defects arising from manufacturing faults and does not extend to damage caused by external factors.

1.2.        Free Battery Replacement – Six (6) Months:

For quartz watches, the Company provides one-time battery replacement, at its discretion, free of charge for a period of six (6) months from the date of purchase, provided that:

    • The battery failure is not due to leakage caused by misuse, exposure to water or external damage.
    • The watch has not been opened or tampered with by unauthorized personnel.

After six (6) months, battery replacement shall be chargeable.

2.              Conditions for Valid Warranty

This Warranty shall be valid only if:

    •  The watch was purchased from an authorized dealer, distributor, or official sales channel of the Company.
    • The original purchase invoice is presented.
    • The warranty card (if issued) is duly completed, stamped, or electronically registered.
    • The watch has been used strictly in accordance with operating instructions and normal usage conditions.

3.              General Exclusions

This Warranty does not cover:

3.1          Normal wear and tear, including but not limited to:

    • Scratches on case, glass, bezel, or bracelet
    • Fading, discoloration, or plating wear
    • Strap deterioration (leather, silicone, fabric, rubber, etc.)

3.2          Damage resulting from:

    • Accidents, drops, impact, or mishandling
    • Negligence or improper storage
    •  Exposure to chemicals, perfumes, solvents, or corrosive substances
    • Water damage beyond the rated water resistance
    • Use contrary to user instructions

3.3          Damage caused by:

    • Unauthorized repair, service, or modification
    • Opening of the case by unauthorized personnel
    • Use of non-original parts

3.4          Damage to:

    • Crystal or glass
    • Crown, stem, pushers, or external components unless caused by a manufacturing defect in movement

3.5          Cosmetic defects arising after purchase.

3.6          Water condensation due to improper crown handling.

3.7          Loss, theft, fire, natural disasters, or force majeure events.

3.8          Any indirect, incidental, special, or consequential damages.

 

4.              Specific Exclusions

4.1          No Buy-Back / No Exchange Policy, accordingly:

    • No watch sold shall be eligible for buy-back, return, or exchange.
    • This applies irrespective of usage status.

5.              Laboratory Grown Diamond Setting Policy:

5.1          If a diamond falls out due to setting issues, it shall be addressed strictly at the sole and absolute discretion of the Company, subject to inspection.

5.2          If a diamond is lost, the Company shall not be liable to replace or compensate for such lost diamond, however the Company may at its sole discretion replace the lost diamond.

5.3          Replacement of lost diamonds, if requested by the customer, shall be chargeable at applicable rates.

5.4          The Company reserves the sole right to determine whether the issue arose from manufacturing defect or external impact/misuse.

6.              Water-Resistance Technical Disclaimer

6.1          If a watch is marked as water-resistant, such rating refers only to laboratory-tested conditions under controlled static pressure and does not constitute a guarantee of permanent or continuous water protection.

6.2          Water resistance is not a permanent condition and may diminish over time due to normal wear and tear. It may be affected by impact, improper handling of the crown or pushers, battery replacement, gasket deterioration, or unauthorized opening of the case. It does not imply suitability for hot water exposure, steam, saunas, high-pressure water, diving, or sudden temperature changes.

6.3          Unless expressly specified otherwise in writing by the Company, water-resistant watches are not designed for professional diving or prolonged submersion.

6.4          Damage resulting from water ingress shall not be covered under warranty unless the Company determines otherwise.

6.5          Customers are advised to ensure that the crown is fully secured at all times and to have water-resistance seals periodically inspected by a service center.

 

7.              Disclaimer of Other Warranties

7.1          Except as expressly stated herein:

    • The Company makes no other express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, durability, or non-infringement.
    • No dealer, retailer, agent, or distributor is authorized to modify or extend this Warranty in any manner.
    • Any representations not expressly contained in this document shall not bind the Company.

8.              Limitation of Liability

8.1          To the maximum extent permitted by applicable law:

    • The Company’s liability under this Warranty shall be strictly limited to repair or replacement of the defective movement.
    • The Company shall not be liable for any indirect, incidental, punitive, special, or consequential damages, including loss of use, loss of time, loss of profits, or reputational loss.
    • In any event, the Company’s total liability shall not exceed the original purchase price of the watch.

9.              Warranty Claim Procedure

9.1          To claim warranty service the customer must submit the watch along with:

    • Original purchase invoice
    • Warranty card (if applicable)

9.2          The Company reserves the right to:

    • Inspect and verify the defect
    • Determine whether the claim falls within warranty coverage
    • Charge service fees if the issue is found to be outside warranty scope

9.3          Shipping costs may be borne by the customer unless otherwise determined by the Company.

For Gold Products:

  1. Exchange and/or buy-back of gold jewellery shall be permitted at the prevailing market price of gold corresponding to the applicable purity (i.e., 18kt or 14kt), as determined by the Company at the time of such transaction. Making charges, GST, and any other charges shall not be considered or refunded under any circumstances. The customer shall provide valid identification and documentation as may be required by the Company for processing exchange or buy-back transactions

  2. Any exchange or buy-back of gold jewellery shall be subject to mandatory quality check, purity testing, and verification of the original invoice and hallmark
    certification, to the satisfaction of the Company
  3. Exchange of gold jewellery against lab-grown diamond studded jewellery (including gold or silver variants) shall not be permitted. 
  4. Gold jewellery shall be sold strictly at the price displayed on the Company’s mobile application and/or CSM software at the time of purchase. No discounts, rebates, or deviations shall be applicable unless expressly approved by the Company in writing.
  5. The buy-back value shall be determined solely by the Company, based on internal evaluation parameters, and may be displayed on the Company’s mobile application or internal systems for reference purposes. 
  6. Gold jewellery shall not be eligible for purchase or redemption using any gift vouchers, gift cards, or similar instruments issued by the Company.
  7. Gold jewellery shall not be eligible for purchase under the “Born to Shine” scheme or any similar savings or investment-linked schemes introduced by the Company.
  8. Discounts, offers, or benefits applicable to diamond jewellery (including lab-grown diamond jewellery), including but not limited to “Redefine” offers or similar promotional schemes, shall not apply to gold jewellery. 
  9. Purchase of gold jewellery may be made using old gold exchange as a mode of payment, subject to successful testing, valuation, and price determination through the Company’s authorized systems (including CSM), at the sole discretion of the Company. The Company reserves the right to refuse exchange or buy-back of any gold jewellery that is not sold by the Company or does not meet its internal quality, purity, or hallmarking standards.
  10. The net weight and value of gold for exchange or buy-back shall be determined after appropriate deductions towards stones, impurities, soldering, wastage, damage, or any non-gold components, as identified during the testing process.
  11. The Company shall not be liable for any minor damage, loss of stones, or changes occurring during the course of standard testing, melting, or quality verification processes, carried out with due care.
  12. For customized gold jewellery orders, the gold rate shall not be blocked or fixed at the time of order placement. The applicable rate shall be the prevailing gold rate on the date of final billing or delivery, as determined by the Company.
  13. Any repair, alteration, or after-sales service in relation to gold jewellery shall be undertaken solely at the discretion of the Company, including determination of feasibility, scope of work, timelines, and applicable charges.
  14. In the event of any dispute, discrepancy, or interpretation issue, the decision of the Company shall be final and binding, to the extent permitted under applicable law.
  15. The Company reserves the right to amend, modify, update, or revise these Terms and Conditions, in whole or in part, at any time at its sole discretion, without prior notice. Any such changes shall be effective immediately upon being updated on the Company’s official communication channels, and continued transactions shall be deemed as acceptance of the revised Terms and Conditions.

PRICES

The taxes and delivery costs are clearly shown and invoiced at the end of the order in addition to the price of the products. We reserve the right to modify our prices at any moment, but this will be indicated to you on the order at the time the order is placed. If an obviously incorrect price appears on our website and is not corrected on your total at the time of order completion, for whatever reason (human error, technical error, etc.), your order will be cancelled and the payment refunded to you, even if it has been initially validated.

ORDERS

Any user wishing to make a purchase may be required to register on the website after adding the item(s) to the shopping cart. The user may be asked to provide any other mandatory information required under law, like a Permanent Account Number (PAN) and/or GS number, at the time of purchase.

Orders are normally considered complete only after the payment has been received by the company, unless otherwise stated.

To confirm the orders, the company may, at random, call up the user who has placed orders through the website and ask the user a verification question. The company will confirm the order only after the verification question is answered by the user.

The company uses one or more third-party payment gateways for the purpose of billing and payment collection. The user hereby agrees to and accepts the terms and conditions of as well as the privacy policy of the payment gateway provider.

The user agrees, understands, and confirms that the credit card details provided by them for availing of services on the website will be correct and accurate. You further agree and undertake to provide the correct and valid credit card details to the company. Further, the said information will not be utilised and shared by the company with any of the third parties unless required for fraud verifications or by law, regulation, or court order. The company will not be liable for any credit card fraud. The liability for use of a card fraudulently will be on you, and the onus to ‘prove otherwise’ shall be exclusively on you.

The company reserves the right to recover the cost of goods, collection charges, and lawyers’ fees from persons using the website fraudulently. The company reserves the right to initiate legal proceedings against such persons for fraudulent use of the website and any other unlawful acts or acts or omissions in breach of these terms and conditions.

AVAILABILITY

We will always endeavour to fulfil your order once completed and paid for. If a product becomes unavailable after your order has been confirmed and paid for, we will refund the price you paid for the product within 30 days following the date of payment. If your order includes products that are temporarily unavailable, we will send the available products out first and will follow with the outstanding items once they are available again. We will refund the shipping fees for the rest of the order. If relevant, we will offer you a replacement for an unavailable product, a product of equal price and quality. If you choose to decline this offer, and the original product is permanently unavailable, we will reimburse the price of the unavailable product.

DELIVERY

The company does everything in its power to respect the delivery schedule indicated on the website. We cannot, however, be held responsible for the consequences of a late delivery or the loss of a package caused by a third party contracted to make delivery, or by you, or because of some unforeseen event or an Act of God. In the event that you do not receive your package, an investigation will be conducted with the carrier and may take several days upon receipt of your claim. During this period of investigation, no reimbursement or redelivery will take place.

At the time of placing the order, the user shall state the full name of the recipient as stated in his/her recipient(s) government-approved photo identification. At the point of delivery, the recipient shall collect the product, furnishing any one of the following government-approved photo identification cards:

  1. Aadhar Card
  2. Driver’s License;
  3. Permanent Account Number (PAN) card;
  4. Voter identification card; or
  5. Passport.

Delivery shall be made by the company/courier agent only after the photo and name of the recipient are verified and confirmed by them. To ensure safe and secure delivery of the package, the details of the government photo identification will be noted. The recipient of the package must cooperate with the courier agent by providing required and valid copies of his/her government-approved photo `identification.

In case the user wants any other person to receive the delivery on his/her behalf, he/she needs to specify details of the same at the point of ordering. All items shall be delivered directly to the other person, and under no circumstances whatsoever can the user change the recipient details after the order is processed.

In the event the user wishes to change the shipping address, he/she is to log in to his/her account on the website and click on the “Change Shipping Address” button next to the shipping address and change the address. This “Change Shipping Address” icon will be active only till the order status changes to "Shipped." If the order status changes to “TShipped," the “Change Shipping Address” link becomes inactive.

All shipping charges and other local charges shall be borne by the company. The recipient accepting delivery should carefully examine the package delivered and shall not accept deliveries where the packaging has been tampered with. The recipient receiving the delivery also has the option to open the package and check its contents prior to accepting the delivery or signing the delivery receipt. They shall not accept deliveries where they find that the box is empty, the contents are damaged, or the contents are not in accordance with the order placed.

The recipient, upon signing the delivery receipt, acknowledges the receipt of the product in terms of the order placed with the company. The company is not liable to the customer/recipient for any refund or replacement, or any circumstance, for any subsequent complaints with respect to such deliveries.

If the recipient is not available at the time of delivery, the company/courierent shall try and deliver the item three times before returning the same to the company. All costs for reshipment handling in the case of non-delivery to the user shall be chargeable to the user.

 

CERTIFICATE

Diamonds

The certificate will be issued by an independent third-party certifying authority. Details of the certificate will be mentioned at the time of purchase.

Jewellery / Mounts

The diamonds in the jewellery/mounts will not be individually certified unless expressly mentioned at the point of placing the order. The entire jewellery will be certified either by an independent third-party certifying authority or by Limelightdiamonds.com, depending on the value of the jewellery.

BUYBACK AND EXCHANGE

The company has a lifetime exchange and buyback policy for the products sold only in India, subject to review by our Quality Assurance Department of the company for the product free from any sort of damage, wear, alteration, resizing, etc. The decision by the Quality Assurance Department of the company shall be final and binding for any sort of lifetime exchange/buyback scheme.

For any sort of lifetime exchange or buyback, we shall require the following:

  1. Original Product.
  2. Original/Copy of Invoice.Product Certificate (if any).
  3. Valid government.  ID proof of the person making the buyback/exchange request.

In case of shipment of product to us under the Life-Time Exchange or Buy Back Scheme, the product should be packed and sealed in a secured manner to avoid any damage in transit, either bubble-wrapped or in a small box or a padded envelope.

In case of reshipping the products under the theme exchange or buy-back scheme, the products need to be shipped with our shipping partners only.

Shipping partners stated below:

The terms and conditions for the Lifetime Exchange scheme are as follows:

●       The company offers a 100% exchange policy to the end customers. Under this scheme, the good(s) can be exchanged by every customer for another good(s) with a value equivalent to 100% of the selling price of the sold good(s).

●       On accepting the goods for exchange, the company shall provide the exchanged goods of the same value as the good being exchanged. No money will be refunded.

●       The good(s) being exchanged should be accompanied with the original certificate and original invoice provided by the retailer or the company. The company does not cover any consequential loss or damage of jewellery or precious stones in studded jewellery.

●       Life-Time Exchange shall not be applicable to orders pertaining to products sold outside India.

●       The exchange shall be subject to the quality check that shall be carried out for the goods being exchanged by the company.

●       An annual logistical fee of Rs 1500/- shall be deducted while determining the exchange value.

The terms and conditions for the Lifetime Buy-Back scheme are as follows:

●       The company shall provide a buyback scheme to every customer. Under this scheme, the goods can be returned by the customers to the retailer or the company for a refund payment totaling the following:

●     100% of the prevailing market price of gold or any other metal used PLUS

●       80% of the prevailing market price of the specific quality of the lab-grown diamonds studded in the jewellery

●       In case of any discounts given during the original purchase, an equivalent amount shall be deducted from the market value of the lab-grown diamonds.

●       The refund amount shall exclude all applied taxes at the time of purchase.

●       The buyback scheme and reimbursement of payment shall be subject to the quality check carried out of the goods by the company.

●       The good(s) should be accompanied with the original certificate and the original invoice provided by the retailer.

●       Buy Back shall not be applicable to orders pertaining to products sold outside India.

●       An annual logistical fee of Rs 1500/- shall be deducted while determining the buyback value.

●       All payments for the buyback value paid by the company will be made through RTGS or NEFT only. Payments shall be made only to the person/entity mentioned in the invoice issued by the retailer and carrying a valid government-issued photo ID and valid certificate of the good.

●       Refunds and payments under the buyback scheme shall be done within 21 business days after receiving the product at our registered office.

To request the return of the product under the Life-Time Exchange or Buyback Policy, you should do the following:

  1. Email our customer care requesting a lifetime exchange or buyback at contact@limelightdiamonds.com.
  2. Call +91-8169469023 to confirm once the package is ready with all the above requisites in order to arrange for the reshipment of the same.

15-DAY RETURN POLICY

Product once returned under the 15-Day Return Policy (Date of Shipping Invoice) will be refunded 100% of the value in your payment source (credit card/debit card/net banking).

In order to be eligible for the return, the product should be accompanied by:

  1. Original packaging in sellable condition with no scratches, wear, damage, or alteration.
  2. Certificate (If Any)
  3. Invoice Copy of the Product
  4. Warranty Card

●       The money-back amount will be 100% of the actual amount paid. In case any coupon, discount, or promo codes were used during the original purchase, the exchange amount will be reduced by an amount equivalent to the coupon, discount, or promo codes, as applicable.

●       In case of a refund on the 15-Day Money-Back, payment of the refund amount shall be done via online bank transfer to the customer’s bank account within 21 business days of receipt of the product. If the mode of payment was through online debit/credit card/net banking, the refund will be processed by reversal of the transaction.

●       In case of a 15-day return policy, a shipping charge of Rs 750/- shall be borne by the customer for all the jewellery under this policy.

●       The 15-Day Policy is applicable only and NOT on customized jewellery

●       To request a return of the product under the 15-day money-back policy, one must do the following:

●       Email to our Customer Care within 15 days from the date of the product invoice at contact@limelightdiamonds.com

●       Call customer care +91-8169469023 to confirm once the package is ready with all the requisites to arrange for the reshipment of the same.

●       We reserve the right to modify this privacy policy at any time, so please review it frequently. Any required changes and clarifications will be updated with immediate effect on our website. If we make material changes to this policy, customers are requested to frequently browse through our policy to be aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.

PRIVACY AND PROTECTION OF PERSONAL DATA

The company takes your privacy seriously and does not compromise on taking stringent measures in protecting your information, including user, payment, and order data. We do not share your information with any third-party systems.

The details you give us are essential for the processing and delivery of your orders, for billing, and for the establishment of warranty contracts; therefore, failure to provide these details will result in the cancellation of your order. By registering on the site, you agree to provide us with sincere and true information as it concerns you. Communicating false information is contrary to the present General Terms and Conditions.

You have the permanent right to access and rectify all the information that concerns you. You can at any time make a request to the company to find out what personal information we hold concerning you. You may at any time, and by request, modify this information.

Cookies record certain information stored on your hard drive. This information enables us to generate statistics based on data from visitors to our site and suggest products that might interest you according to the items that you selected when you previously visited the site. Cookies do not contain any confidential information about you.

This privacy policy is meant to help the users understand what information we collect, why we collect it, what information we disclose and how the users can update, manage, export, and delete their information. It shall be read with the terms and conditions/terms of service available on our website name privacy policy (Terms) and in compliance with the following:

Digital Personal Data Protection Act, 2023; The Information Technology Act, 2000 and rules thereunder; The Information Technology (Reasonable Security Practices and Procedures and Personal Information) Rules, 2011 (the IT Rules); and The Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021.

 

INTELLECTUAL PROPERTY OWNERSHIP

All the content on the company website (illustrations, texts, names, brand names, images, and videos) is the property of the company. Any partial or total reproduction of this content, by any means and on any support, is subject to prior and express authorisation by the company. All information, content, and files are protected by law concerning intellectual property ownership and copyright. The company cannot give you the right to copy, display, or distribute content that you do not have the intellectual rights to. All fraudulent use of this content that violates the rights held by a third party constitutes an offence of forgery, which is severely punished under the intellectual property laws governing India.

Company will not, under any circumstances, be held responsible if a user violates rights held by a third party through his activities on the site.

WAIVER AND SEVERABILITY

Any failure of the company to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision.
